Please read these terms carefully before booking our photography services.

Welcome to Mount Fuji Photographer (operated by JCG Satsuei Group). These Terms of Service ("Terms") govern your use of our photography and videography services.

By booking, paying for, or using our services, you agree to be bound by these Terms. Please read them carefully before making a booking.

1. Agreement to Terms

By submitting a booking request, making a payment, or participating in a photography session with Mount Fuji Photographer, you acknowledge that you have read, understood, and agree to these Terms of Service.

These Terms constitute a legally binding agreement between you (the "Client") and JCG Satsuei Group (the "Photographer" or "we").

If you do not agree to these Terms, please do not book or use our services.

2. Booking & Payment

Payment Policy

Full payment (100%) is required at the time of booking to confirm your reservation. Bookings are not confirmed until payment is successfully processed.

  • All payments are processed securely through Stripe, our trusted payment processor.
  • We accept credit cards, debit cards, Apple Pay, and Google Pay.
  • Payment confirmation will be sent to your email address upon successful booking.
  • All prices are quoted in Japanese Yen (JPY) and are subject to change without notice.
  • Payments are non-refundable except as outlined in our Cancellation Policy (Section 3).

3. Cancellations & Rescheduling

We understand that plans can change. Our cancellation and refund policy is as follows:

Rescheduling

  • Clients may request to reschedule their session up to 7 days before the scheduled date at no additional charge, subject to photographer availability.
  • Rescheduling requests made less than 7 days before the session may be subject to cancellation fees as outlined above.
  • Rescheduling due to weather conditions (see Section 4) is handled separately.

No-Show Policy

If you do not arrive for your scheduled session and do not notify us in advance, the full payment is forfeited and no refund will be issued.

Refund Processing

Approved refunds are processed within 7–10 business days to the original payment method used at booking.

4. Weather & Force Majeure

Photography sessions at Mount Fuji and outdoor locations are subject to weather conditions and natural circumstances beyond our control.

Important: Mt. Fuji Visibility

The visibility of Mount Fuji cannot be guaranteed. Mt. Fuji is often obscured by clouds, fog, or weather conditions, especially during certain seasons. The photographer is not responsible if Mt. Fuji is not visible during your session.

Weather-Related Rescheduling

  • Severe Weather: In the event of heavy rain, typhoon, dangerous conditions, or government-issued weather warnings, we will contact you to reschedule your session at no additional charge.
  • Light Rain or Clouds: Sessions may proceed in light rain or overcast conditions unless the client or photographer determines it is unsafe or unsuitable. Umbrellas and covered locations may be suggested.
  • Rescheduling Availability: Weather-related rescheduling is subject to photographer availability. If rescheduling is not possible within a reasonable timeframe, a full refund will be issued.

Force Majeure

The photographer is not liable for delays, cancellations, or inability to perform services due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters (earthquakes, typhoons, volcanic activity)
  • Government restrictions or emergency declarations
  • Public health emergencies
  • Transportation disruptions
  • Acts of God

In such cases, we will work with you to reschedule or provide a refund at our discretion.

5. Client Responsibilities

To ensure a smooth and successful photography session, clients agree to the following responsibilities:

  • Arrive on Time: Arrive at the agreed meeting location at the scheduled time. Late arrivals will result in reduced session time (see Section 10).
  • Obtain Necessary Permits: If your chosen location requires permits, licenses, or special permissions, you are responsible for obtaining them in advance. The photographer can provide guidance but is not responsible for permit acquisition.
  • Follow Local Rules: Respect all local park rules, public space regulations, and cultural norms. The photographer is not responsible for restrictions imposed by third parties (park staff, security, property owners).
  • Provide Accurate Information: Provide correct contact information, session details, and special requests at the time of booking.
  • Communicate Changes: Notify the photographer immediately of any changes to your booking, contact information, or session requirements.
  • Respectful Conduct: Treat the photographer and any assistants with respect. Abusive, threatening, or inappropriate behavior may result in immediate session termination without refund.

The photographer reserves the right to refuse service or terminate a session if the client fails to meet these responsibilities or engages in unsafe or illegal conduct.

6. Delivery of Services

Delivery Timeline

Professionally edited photos and videos will be delivered within 5–14 business days from the date of your session.

Delivery Method

All final images and videos are delivered digitally via a private, secure Google Drive link sent to your email.

  • File Format: High-resolution JPG images for photos. MP4 (H.264) format for videos. Custom formats available upon request.
  • File Access: Your files will remain accessible on Google Drive for 30 days from delivery. Please download and back up your files promptly.
  • RAW Files: Unedited RAW image files are not included in standard packages. RAW files may be purchased separately for an additional fee.
  • Rush Delivery: Expedited delivery (1–3 business days) is available for an additional fee, subject to availability.
  • Number of Images: The number of edited images delivered depends on your selected package and will be specified in your booking confirmation.

The photographer retains the right to select which images are edited and delivered based on technical quality and artistic merit.

7. Intellectual Property & Usage Rights

Copyright Ownership

The photographer retains full copyright and ownership of all photographs and videos created during your session. This includes all edited images, RAW files, and any derivative works.

Client License

Upon receipt of full payment, clients are granted a non-exclusive, royalty-free license to use the delivered images for personal, non-commercial purposes, including:

  • Sharing on personal social media accounts
  • Printing for personal display or gifts
  • Sharing with family and friends
  • Using as personal profile pictures

Commercial Use Restrictions

Commercial use of images is prohibited without prior written permission from the photographer. Commercial use includes but is not limited to:

  • Advertising, marketing, or promotional materials
  • Sale of prints or digital copies
  • Use in commercial publications or websites
  • Use by businesses or brands

If you require commercial usage rights, please contact us to discuss licensing options and fees.

Photographer's Portfolio Rights

Unless otherwise agreed in writing prior to the session, the photographer reserves the right to use selected images from your session for:

  • Portfolio display and promotional purposes
  • Website gallery and marketing materials
  • Social media posts (Instagram, Facebook, etc.)
  • Photography competitions and exhibitions
  • Educational or training purposes

Prohibited Actions

Clients may not:

  • Remove watermarks, logos, or photographer credits from images
  • Alter, edit, or modify delivered images without permission
  • Claim ownership or copyright of the images
  • Resell or redistribute images for profit

8. Privacy Requests

We respect your privacy. If you prefer that your images not be publicly shared on our website, social media, or portfolio, you may request privacy protection.

Important Notice

Privacy requests must be made in writing prior to your photography session. Requests made after the session may not be honored if images have already been published.

To request privacy protection, please email us at [email protected] with "Privacy Request" in the subject line before your session date.

Note: Privacy requests do not affect your personal usage rights. You may still share your images on your own social media and personal channels.

9. Limitation of Liability

To the fullest extent permitted by law, the photographer's total liability for any claims arising from or related to our services is limited to the total amount paid by the client for the specific session in question.

Exclusions

The photographer is not liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, or business opportunities
  • Emotional distress or personal injury (except as caused by gross negligence)
  • Loss or damage to personal property brought to the session
  • Failure to capture specific moments or poses if not communicated in advance

Equipment Failure & Technical Issues

While we use professional-grade equipment and maintain backups, the photographer is not liable for equipment failure, memory card corruption, or other technical issues that may result in loss of images.

In the unlikely event of catastrophic equipment failure or data loss, we will offer reasonable compensation such as a partial refund or complimentary reshoot, at our discretion.

Third-Party Restrictions

The photographer is not responsible for restrictions, removal, or interruptions caused by:

  • Park rangers, security personnel, or property owners
  • Permit denials or location closures
  • Other visitors or members of the public

Some jurisdictions do not allow limitations on liability. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.

10. Late Arrivals & Session Time

Session time is fixed and begins at the scheduled start time, regardless of client arrival time.

Late Arrival Policy

If you arrive late to your session, your session end time will not be extended. Late arrival reduces your total shooting time. For example, if you arrive 30 minutes late for a 1-hour session, you will have 30 minutes remaining.

  • No refunds or credits will be issued for reduced session time due to late arrival.
  • If you arrive more than 30 minutes late without prior notice, the photographer reserves the right to cancel the session and apply the standard cancellation policy.
  • If you know you will be late, please contact the photographer immediately. We will do our best to accommodate minor delays when possible.

Overtime & Extended Sessions

If you wish to extend your session beyond the booked time:

  • Overtime is subject to photographer availability and schedule.
  • Additional fees will apply and must be agreed upon before extending the session.
  • Overtime cannot be guaranteed, especially during peak season or back-to-back bookings.

11. Dispute Resolution & Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Japan.

Jurisdiction

Any disputes, claims, or legal proceedings arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Yokohama, Kanagawa, Japan.

Informal Resolution

Before initiating any legal action, we strongly encourage clients to contact us directly to resolve any concerns or disputes. Most issues can be resolved through open communication.

Language

In the event of any discrepancy between the English version and any translated version of these Terms, the English version shall prevail.

12. Changes to These Terms

We reserve the right to modify, update, or replace these Terms of Service at any time without prior notice.

Changes will be effective immediately upon posting to our website. The "Effective Date" at the top of this page will be updated to reflect the date of the most recent changes.

It is your responsibility to review these Terms periodically. Your continued use of our services after any changes constitutes acceptance of the updated Terms.

Important: The Terms in effect at the time of your booking will apply to your specific session, unless otherwise required by law.
